1. Introduction

Welcome to Hotel’s Future! These Terms of Service (“Terms”) constitute a legally binding agreement between you and Hotel’s Future (referred to as “Hotel’s Future,” “we,” “us,” or “our”) governing your access to and use of our website, mobile applications, and services (collectively, the “Platform”).

1.1 Acceptance of terms

By registering for an account, accessing, or using our Platform, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. Hotel’s Future is operated and managed by Zdenek Kures, a self-employed freelancer. If you do not agree to these Terms, you must not access or use our Platform.

2. Definitions

  • “Content” means all text, information, data, materials, images, videos, audio, and other content available on or through the Platform.
  • “Instructor Content” means Content created, uploaded, or provided by industry experts and instructors.
  • “User” means any individual who accesses or uses the Platform, whether registered or not.
  • “Membership” means digital subscription-based access to our Platform at different tiers.
  • “Tips” means the points earned through our Learn&Earn loyalty program.

3. Changes to Terms

We may modify these Terms at any time by posting revised Terms on the Platform. The revised Terms will become effective immediately for new users and 30 days after posting for existing users. Your continued use of the Platform after the effective date constitutes acceptance of the modified Terms. If a material change is made, we will provide reasonable notice via email or through the Platform.

4. Account Registration and Eligibility

4.1 Account Creation

To access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

4.2 Account Security

You are responsible for safeguarding your password and for all activities that occur under your account. Notify us immediately at hello@hotelsfuture.com if you suspect any unauthorized use of your account.

4.3 Age Requirements

You must be at least 18 years old to create an account. If you are under 18 but at least 16 years old, you may use the Platform only with the involvement and consent of a parent or legal guardian.

4.4 One Account Per User

Each user may maintain only one active account. Multiple accounts owned by the same user may be terminated without notice.

5. Memberships, Individual Courses, and Payment Terms

5.1 Membership Tiers

We offer two membership tiers:

  • Explorer (Free): Basic access to selected content and features
  • Innovator ($49/month): Enhanced access to premium content and features

5.2 Subscription and Billing

Paid memberships are billed in advance on a monthly basis and will automatically renew until canceled. You authorize us to charge your payment method for all fees incurred.

5.3 Free Trials

We may offer free trials to new subscribers. Unless you cancel before the trial ends, we will automatically charge your payment method for the first subscription period at the then-current rate.

5.4 Digital Membership Cancellation and Refunds

  • By subscribing to our digital membership, you expressly consent to immediate access to digital content
  • In accordance with this immediate access, all membership payments are final and non-refundable
  • You may cancel your subscription at any time through your account settings
  • Cancellation will stop future billing but your access will continue until the end of your current paid period
  • No refunds will be issued for partial billing periods

5.5 Price Changes

We reserve the right to adjust pricing for our subscriptions. Any price changes will be communicated to you at least 30 days in advance and will take effect at the start of the next billing period.

5.6 Individual Course Purchases

In addition to subscription memberships, we offer individual courses for one-time purchase. Course prices are displayed on the respective course pages and may vary based on content, length, and instructor.

5.7 Course Access

When you purchase an individual course:

  • You receive access to that specific course content for the period specified on the course page
  • Access is limited to the registered account holder only
  • Access rights are non-transferable and non-assignable

5.8 Course Pricing and Payment

  • All course prices are displayed in USD (United States Dollar) and are inclusive of applicable taxes
  • Payment is required in full at the time of purchase
  • We accept major credit cards and other payment methods as indicated during checkout
  • Price changes will not affect courses already purchased

5.9 Digital Products and Refund Policy

For all customers: 

  • Our digital products (courses and materials) are non-refundable once access has been granted
  • By completing your purchase, you acknowledge and agree that:
    • You will have immediate access to digital content
    • Due to the nature of digital products, all sales are final
    • No refunds will be provided except where required by applicable law

For EU Customers:

  • In accordance with EU Consumer Rights Directive (2011/83/EU), you expressly consent to immediate access to digital content and acknowledge that you will lose your right of withdrawal once access begins
  • This consent will be recorded during the checkout process as required by EU law

For US and International Customers:

  • This “no refund” policy is part of our Terms of Service that you agree to during purchase
  • We clearly display this policy during the checkout process before payment is completed

5.10 Relationship with Memberships

  • Individual course purchases are separate from membership subscriptions
  • Purchasing a course does not grant membership benefits beyond that specific course
  • If you purchase a membership that includes courses you’ve already bought individually, no refund or credit will be provided for the individual purchase

5.11 Payment Processing

  • We use third-party payment processors to handle all financial transactions
  • By making a purchase, you agree to the terms and conditions of these payment processors
  • We do not store full credit card information on our servers

5.12 Subscription Disclaimers

  • No guarantee of specific outcomes or results from using our Platform
  • Content availability may change over time
  • Features may be added, modified, or removed during your subscription period

5.13 Promotions, Discounts, and Special Offers

5.13.1 Promotion Eligibility

  • Promotional offers, discount codes, and special pricing are available only to eligible users as specified in the promotion terms
  • We reserve the right to determine eligibility for any promotion at our sole discretion
  • Promotions are typically limited to one per user/account unless otherwise specified

5.13.2 Promotion Validity and Redemption

  • All promotions have a specified validity period and expiration date
  • Promotional codes must be applied at the time of purchase/subscription and cannot be applied retroactively
  • We are not responsible for lost, stolen, or expired promotional codes

5.13.3 Promotion Restrictions

  • Promotions cannot be combined with other offers unless explicitly permitted
  • Promotions cannot be exchanged for cash or monetary credit
  • Promotions may not be applicable to all courses or membership tiers
  • Promotional discounts apply only to the initial subscription period unless otherwise specified

5.13.4 Modification and Cancellation

  • We reserve the right to modify, extend, or terminate any promotion at any time
  • In case of suspected fraud or technical issues, we may invalidate specific promotional codes or entire promotions
  • We may revoke promotional benefits if obtained through unauthorized means or in violation of these Terms

6. Content and Platform License

6.1 Platform License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Platform for your personal, non-commercial educational purposes.

6.2 Content Access and Lifetime Access

Your subscription provides access to Content for the duration of your active membership. We do not guarantee lifetime access to any Content. If your subscription ends, your access to subscription-only Content will terminate.

6.3 Content Availability

We reserve the right to remove or modify Content at any time for any reason. While we strive to maintain all Content, we do not guarantee that any specific Content will remain available indefinitely.

6.4 Restrictions

You may not:

  • Copy, reproduce, distribute, publicly display, or create derivative works from Platform Content
  • Use the Platform or Content for any commercial purpose
  • Transfer your account or subscription to another person
  • Use the Platform to store or transmit malicious code or conduct illegal activities
  • Attempt to decompile, reverse engineer, or disassemble any portion of the Platform
  • Circumvent or disable any security or technological features of the Platform

7. Learn&Earn Loyalty Program

7.1 Program Overview

The Learn&Earn program allows users to earn “Tips” by engaging with the Platform. Tips can be redeemed for discounts on subscriptions or individual courses and other benefits as described in our Learn&Earn Program Rules.

7.2 Earning Tips

Tips are earned through specified activities, including course completion, forum participation, and referrals. Earning rates may change with notice.

7.3 Redeeming Tips

Tips can be redeemed for benefits specified in our program materials. Redemption values may change with notice.

7.4 Expiration and Forfeiture

Tips do not expire after being earned unless otherwise specified. Tips are forfeited upon account termination or prolonged inactivity (6+ months).

7.5 Program Changes

We reserve the right to modify or terminate the Learn&Earn program at any time with 30 days’ notice. In case of program termination, you will have 90 days to redeem accumulated Tips.

8. User Content and Conduct

8.1 User Content

“User Content” means any content you submit to the Platform, including profile information, comments, questions, reviews, and forum posts.

8.2 License to User Content

By submitting User Content, you grant Hotel’s Future a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with the Platform and our business operations.

8.3 User Content Representations

You represent and warrant that:

  • You own or have the necessary rights to your User Content
  • Your User Content does not infringe on the intellectual property or other rights of any third party
  • Your User Content complies with these Terms and all applicable laws

8.4 Prohibited Content

You may not post User Content that:

  • Is unlawful, harmful, threatening, abusive, harassing, defamatory, or invasive of privacy
  • Contains hate speech, discrimination, or explicit content
  • Infringes on intellectual property rights
  • Contains unsolicited promotional materials or spam
  • Impersonates any person or entity
  • Contains software viruses or malicious code

8.5 Content Monitoring

We do not review all User Content before it is posted. We reserve the right to remove any User Content for any reason without notice. We are not responsible for any User Content posted by users.

9. Intellectual Property Rights

9.1 Hotel’s Future Content

All Content on the Platform, excluding User Content and certain Instructor Content, is owned by Hotel’s Future or its licensors and is protected by copyright, trademark, and other intellectual property laws.

9.2 Trademarks

Hotel’s Future, the Hotel’s Future logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Hotel’s Future or its affiliates. You may not use such marks without our prior written permission.

9.3 Copyright Infringement

If you believe that any Content on the Platform infringes your copyright, please contact us at copyright@hotelsfuture.com with the following information:

  • Identification of the copyrighted work claimed to be infringed
  • Identification of the allegedly infringing material
  • Your contact information
  • A statement of your good faith belief that the material is not authorized
  • A statement, under penalty of perjury, that the information is accurate and you are authorized to act on behalf of the copyright owner

10. Third-Party Links and Content

10.1 Third-Party Links

The Platform may contain links to third-party websites or resources. We provide these links only as a convenience and are not responsible for the content, products, or services on or available from those websites.

10.2 Third-Party Content

Certain Content on the Platform may be provided by third parties. We do not endorse or guarantee the accuracy of such Content and are not responsible for any third-party Content.

11. Termination

11.1 Termination by You

You may terminate your account at any time by following the instructions on the Platform. Upon termination, your right to access subscription content ceases.

11.2 Termination by Us

We may suspend or terminate your access to the Platform, without notice or liability, for any reason, including if we believe you have violated these Terms.

11.3 Effect of Termination

Upon termination:

  • Your access to subscription content will end
  • Any outstanding payment obligations will remain
  • Sections that by their nature should survive termination will continue in effect

12. Disclaimers

12.1 Platform Disclaimer

THE PLATFORM AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, SUITABILITY FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

12.2 Content Disclaimer

We do not guarantee the accuracy, completeness, or usefulness of any Content. Any reliance you place on such Content is strictly at your own risk.

12.3 Platform Operation

We do not warrant that the Platform will be uninterrupted, timely, secure, or error-free, or that defects will be corrected.

13. Limitation of Liability

13.1 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOTEL’S FUTURE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE PLATFORM
  • ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE PLATFORM
  • ANY CONTENT OBTAINED FROM THE PLATFORM
  • UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT

13.2 Cap on Liability

IN NO EVENT SHALL HOTEL’S FUTURE’S TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT PAID BY YOU TO HOTEL’S FUTURE DURING THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.

13.3 Exclusions

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for certain types of damages. Accordingly, some of the above limitations may not apply to you.

14. Indemnification

You agree to defend, indemnify, and hold harmless Hotel’s Future and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with your access to or use of the Platform, your violation of these Terms, or your violation of any rights of another.

15. Dispute Resolution

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of [Jurisdiction], without regard to its conflict of law provisions.

15.2 Mandatory Arbitration

Any dispute arising from these Terms shall be resolved through binding arbitration conducted by the International Chamber of Commerce International Court of Arbitration under its rules. The arbitration shall take place in Prague, Czechia, and judgment on the award may be entered in any court of competent jurisdiction

15.3 Class Action Waiver

YOU AND HOTEL’S FUTURE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

15.4 Exceptions

Nothing in these Terms will prevent either party from seeking injunctive or other equitable relief from the courts for matters related to data security, intellectual property, or unauthorized access to the Platform.

16. General Provisions

16.1 Entire Agreement

These Terms, together with the Privacy Policy and any other legal notices published by Hotel’s Future on the Platform, constitute the entire agreement between you and Hotel’s Future concerning the Platform.

16.2 Severability

If any provision of these Terms is found to be unenforceable, that provision shall be enforced to the maximum extent possible, and the remaining provisions shall remain in full force and effect.

16.3 No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision.

16.4 Assignment

You may not assign or transfer these Terms without Hotel’s Future’s prior written consent. Hotel’s Future may assign or transfer these Terms without restriction.

16.5 Force Majeure

We will not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemic, war, terrorism, riots, civil unrest, government action, labor disputes, or Internet service disruptions.

When we no longer need personal information, we securely delete or anonymize it.
